EU national wanting to move to an EU country with non EU

Post by falak85 » Sun Apr 07, 2013 12:32 am

Hi people,
Basically i wanted to know some information. I am a 20 year old British national who has the righ to move to any EU country without a visa for 90 days. Is it true that i dont have to work or study in that country for those 90 days? Or should i already have a job when i move there? Also i want to take my husband with me to that EU country which is most likely to be spain. In that case because i want to take my husband is it vital that i have a job there before i go? And one final thing, do i need my marriage certificate from the country that i am a national of? because my husband in a pakistani national and has not been to the UK, so we do not have a certificate from the Uk.
I would be very greatful to anyone answering my questions.

For you, you never require a visa to move to another EU country. You can remain in any EU country for three months if you hold a valid passport. After that you need to be a worker, self-sufficient or a student. Your family members can be with you.

Your husband would require a visa. Spain may require that your marriage certificate is translated and legalised.

hi, thankyou for your response,
I wanted to know that which visa should my husband apply for? Shecgen or tourist? As we want to obtain a residence card... as we will be staying for longer than 90 days or can we apply for a residence card on any of these visas?

Visas and residence cards are two separate issues. It is possible to apply for one without the other and visa versa.

A short term entry visa (same as tourist in effect) is what should be appliced for.

You don't need a job on arrival, but you should start to look for work at once (or begin study). Reason is that you must have a job or be a student by the end of the 90day time limit, if you want your husband to be allowed to remain.

Many UK citizens in your position are coming to Ireland - as it is the same language as the UK, it is easier than Spain.

You need original marriage cert.
