04-April - ILR - Approved - Tier 2 ICT

Hello All,

Thank you for all the support, without which it would have been a difficult journey.

My Case:
WP + Tier 2 ICT - Same employer

Complications:
Employer Letter - Will not state the reason as ILR and will not state that 'salary is above the SOC code'

Absence letter - Employer will not provide - 39 days for me

Appointment Details:
04-April - 09:10 - Croydon

Reached PEO @ 08:15

Completed Security Check - 08:20

Token Issue - 08:25

Payment - 08:30

Initial check on Application, Passport, Photos - 08:40

2nd Floor - Biometrics Completed - 09:10

09:10 to 10:00 Waiting for CW to call the token No.

10:00 - Token called

10:00 - 10:05 - Asked to submit all the documents, including copies
Question Asked - Are you with the same employer for 5 years - Yes is the answer
Documents Submitted -
Application Form
Photos
Passport + BRP
LIUK
Reference letter
Absence letter - Personal letter from me for 39 days
12 Months Pay slip
Bank Coverling letter
Current + Savings account statment for 12 months

10:30 - CW called me and provided the approval letter.

10:35 - Out of PEO

By Gods grace and wishes from Family and Friends made this happen.

Congratulations! Seems like it was a smooth process within Croydon. Did they asked you anything else other than the employer question?

Hi DK,

I went alone, as I was not sure of the result.

I will be applying for dependents once I receive the BRP. Please can you confirm Set(O) is the right form for dependents.

Hi Keerthi ,

I'm also little confused whether it is SET(M) or SET(O). I had posted similar query and Vinny said it is SET(O).
I would request Vinny/other senior member to comment on this.

Hi,


My bank is HSBC, when I asked for a covering letter, they said...

1. They have a standard format - addressed only to me - customer as they cannot address it to anyone else due to confidentiality issues

2. In the letter (only for current account) they have mentioned my A/C no., current balance, open date etc.

3. Apart from this they have also mentioned I have min balance of £XXXX for the past 3 months and My salary is being credited to this account monthly

P60's - I have divided my folders in to 4

1. Main - All documents requested in Set (O) form

2. Copies - Copy of all documents in Main

3. Main Support - WP, Degree, P60's ( 2 sets - 1st set for past 2 and 2nd set for previous 2 as my salary structure was different), Medical documents supporting absence, Original deputation letter to support paid holidays, my 12 month salary breakup table for providing how much is the take home after tax, Payslips for vacation period to show that all are paid

4. Aux Support - 2 copies of Set (O) form, previous extension approval letter, leave screen shots from the system etc

The surprise is that I have received my BRP exactly after 47 hours!!! ( Thursday 10:30 Approval, Sat 10:00 AM BRP delivered )

Can someone confirm on whether I can use Set(O) for my Wife and Kid.

Hi,

Mine is a simple bonafide/reference letter with- date of joining, date of arrival in UK, name, role, salary, address.

One difference is along with role, I have requested for SOC code.

Purpose given for me is mentioned as dependent Visa processing for my Son.

Hi,

I have provided a personal letter stating that all the absences mentioned ( in a table for each year of my stay in UK) are for compelling reasons. As my total is only for 39 days, I was thinking of providing a justification of family visit. I also had evidences of 20 days paid leave per annum and the pay slips during my vacation stating that all the days are being paid.

Have you done your wife + Kid. Can you share me your experience. Also, btw i have one query - How did you calculate your date of appointment...

Have you considered CoS expiry-28 days or Visa Expiry-28 Days (Date on BRP Card)

Hi Keerthi,

Can you please let me know ifthere was any period in 5 years of your stay when you were not having any valid visa.I am asking you this question, as even i am having combination of WP and Tier 2 visa in last 5 years.

To sum up my stay in last 5 years is like this:

Jan 2009-Dec 2009: No break
Jan 2010-Dec 2010: Break of 30 days. Went on holiday to India.
Jan 2011-Dec 2011: Break of 120 days. Went back to India for visa restamping. During this break period I was not having any valid UK visa.
Jan 2012-Dec 2012: Break of 60 days: Went to India on Holiday.
Jan 2013-Dec 2013: No break.

During all these years, I am with the same employer.

My query is:
1. Can I apply for ILR on 2 different Visas?
2. For second term, I entered UK in May 2011 (that is post Apr 2010 when the rule for Tier 2 ICT changed), am I still eligible. Will my start date be considered as Jan 2009 when i came on WP or will it be May 2011?
3. As there was a gap of 4 months (though less than 180 days) between my 2 visaS, during that period I was not in UK, can I still apply for ILR?

Please share your thoughts.
