MN1 Form Born in the UK but with LTR

Post by purplepple » Fri Apr 05, 2013 10:54 pm

Hi

Would appreciate your help. I'm filling in the MN1 Form for my son who is born in the UK. We will submit the form soon after us parents get our ILR. My son has a Leave to Remain visa. My question is regarding question 2.1

2.1 If the child is resident in the United Kingdom or a British overseas territory (see page 8 of the guide), please give
date and place of first arrival

Given that he was born in the UK and not entered the UK, is this question not applicable? However, he has an LTR as my dependent therefore he is a (temporary) resident. Also, he's already travelled outside the country for a holiday.

Should the date then be when he got the LTR, or when he re-entered the UK from a holiday, or given that he never had an entry clearance this is not applicable?

Should I include his passport in the MN1 application or just the birth certificate?

I suppose that his date and place of first arrival were when and where he was born.

I understand you can apply for your UK born son if he is non traveling. In your case he has been out of country so he will need to apply for ILR with you first. I am in simillar situation, please some one let us know if I am wrong. Thank you for help.

Reading the guidance again, question 2.1 is only applicable to children born outside the UK so this is not applicable to us and will not be filling this out. However, I'm not sure whether 2.2 onwards should still be filled esp that my son travelled outside the UK.

If so, then does that mean I need to provide his passport to support the number of days of absences? (He only has 33 days absences). But the guidance only says to provide the child's passport of entry which is not applicable since he was born in the UK.
