Bank letter refusal (Entrepreneur Team 50k)

Bank letter refusal (Entrepreneur Team 50k)

Application: Entrepreneur team application

Me & my friend both have 20k each in our personal bank accounts in UK.
10K had been already invested.
Provided a decalaration signed by both team members and attested by solicitor that we both have equal shares in our Ltd company and will invest 20k each for our business.
Application date: 23October 2012
Refusal 4th April 2013

Reason: As you are relying on third party funds, your third party should confirm that the amount is available to you till you invest it, bank letters of each member should confirm that money is accessible to each sides.

UK banks dont provide the specified letter, which could confirm that since our customers is a sponsor of xyz applicant, so money is always available till investment to xyz.

Any expert's, suggestions , help will be highly appreciated as we have launched the appeal and am waiting for hearing date.

. I called my bank last night and they have one option of third party mandate which can allow an individual to have access to your bank. I will visit lloyds branch later on today

my situation is that my visa has already been expired and I cannot make fresh application even if I get that third party mandate letter from bank. I have only option now and that is to appear before the judge and try to defend the documents which I sent to the HO at the time of application.
Solicitor says that we can provide new documents to the judge as well but I am not sure about this as HO have objected on the documents already provided at the time of application and have not asked me to send new documents.
Dont know if there is any legal way in my favor. :(

You can re apply within 28 days from the date of refusal if you can get all the required documentation.

Rooney0411. Thank you for your advice.

The letter they sent me along with the refusal is that I can make an appeal, & it is not mentioned anywhere on letter that I may re-apply. My visa has already been expired on 28th of October 2012. Can I still make a fresh application with in 28 days of refusal letter ?? could you please provide me source of this rule ?

You must not have overstayed more than 28 days to apply for further leave to remain.

Your leave expired on 28th Oct but you applied further leave to remain. You status was legal while your application was pending. So technically you were staying legally still the date on your refusal letter.

You can apply for further leave to remain for any other category, provided, if you are eligible and meet all other requirements.

Note: You will not get any appeal rights in case your application is refused next time, as this will be considered as out of time application.

It depends what you want to do.

Technically, your status stays same as your previous.

i-e If your previous leave was Post Study Work till 28th Oct 2012 and your application is refused in Apr 2013, your current status will be considered under PSW. (Any time spent in your Appeals in First Tribunal & Upper Tribunal processes will also be disregarded, provided you sent your appeals within given timeframe, your current status stays same as PSW).
