Hi.
Is investing in setting up a shop or kiosk and recruiting sales staff for that besides providing business management services falls under nvq required level. My designation issales and mmarketing manager , so can I set up a shop as well as that would creat vacancies as well ?

If switching from PSW, this type of business is not permitted for Tier 1 (Ent) as it's not at Level 4. |There is no restriction for the 200K threshold of capital

Yes. It's the business activity that matters rather than how you describe your role in that business. You have to read the guidance as all of this is very clearly defined.

Yes thats true. My main business is providing business management services which is running. In future I want to invest in couple of kiosks and employee sales staff. My main role will be obviously managerial. So can we not do multiple businesses ?

Can you define the exact nature of your current business (or do you already have a Tier 1 (ent) leave based on that?). If you already have a business that operates at level 4 there is nothing to prevent you opening another business that is not at level 4, but that would be a separate entity to the original business.

Let's cut to the crux of this matter. Are you currently a PSW migrant worker intending to apply for Tier 1 (ent) on the basis of a business? Is that business a retail management service provider? What SOC code will you be choosing for the application?
Mangers and directors in retail and or wholesale fall under SOC 1190 - which is not a level 4 occupation.

Yes it is business and retail management service provider company and my designation is marketing and sales manager. We got a client who got more than 50 kiosks across uk. We are providing them this service currently. We would expand this once we get confirmation of visa. Now besides this I also want to set up couple of kiosks with a product and put sales staff there. So is this all alright ?

I am currently on psw and applying for tier 1 entrepreneur. Soc is 1132 which is nvq level 6

1132 is marketing and sales director (and, indeed, you can apply any title you wish to you actual role in the business) but the business you have described is not a level 4 activity. There are no retail activities at level 4. Your application will fail.

I'm saying that retail management is not a level 4 activity. So if that is the type of business for which you will be a business manager or consultant, it will not qualify. Everything stems from the core business activity and you can call yourself whatever you like, but if the activity of the entity is not level 4, it will not work.

Okay, if you are indeed granted a Tier 1 (ent) leave based on that business consultancy scenario, there is nothing to prevent you opening another business that operates kiosks. You can't work for that business (take a salary) but you can be a director of that business (take a dividend). The points you need to score to extend your Tier 1 leave will be based on the original consultancy business rather than the kiosk business. Employees of the kiosks can't, therefore, qualify for the points necessary for tier 1 extension.

Ok thanks. I have an interview on 18th. They obvioulsy would ask my plans so shall I mention the kiosk business as well or just stick to business consultancy business ? As wegonna get office , recruit more staff etc in our consultancy business -

Well the kiosk business is not relevant and to mention it would only cast doubt on the true nature of your application. You would have to ask yourself: if I could use the kiosk business to apply for Tier 1, would I do that instead?

Adeel168, don't complicate things for yourself; never mention kiosk at the interview.
