EEA Family Permit - need advice

Post by rachbuka » Tue Apr 16, 2013 1:04 pm

Hi,

My husband is a Nigerian and I am an EEA national and I just relocated to the UK. We have been married 2 years and we have stayed together in Nigeria. We have been refused my home country visa before. We want to apply for the EEA family permit.

We want to relocate to the UK because Nigeria is becoming more dangerous with each passing day.

Here are our CHALLENGES:
- We don't have any official prove that we have been staying together in Nigeria (the tenancy agreement is on my husband and the bills are on our land lady's name, no joint account)
- We don't have my husband's previous intrnational passport (the one with visa refusal - it got lost)
- terrorism spreads in Nigeria and there are so many cases of fake documents in Nigeria so I think it will be extrememly difficult to get this permit / they suspect Nigerians /
- I have been in UK just 2 weeks now but can't find any job (even in the factories) :(
- My husband has never been to Europe and has never met my parents (we have met in Nigeria)

Here is the list of documents we want to provide together with the application:

- marriage certificate issued in my country
- marriage certificate from Nigeria
- copy of my passport (does it really have to be endorsed by my Embassy?)
- My payslips from UK (don't have them yet - no job)
- my employment letter from Nigeria
- my resignation letter from Nigeria (I resigned because of the issue the comapny had with my husband, so the letter somehow proves that we are a genuine couple)
- e-mail alarts from bank in Nigeria about salary being debited into my account (the company doesn't issue any payslips!!! and I cant access my bank statement, because it is a salary account and only the management can access the account...) We want to provide this to prove how we have been surviving in Nigeria. My husband worked without contract, so we don't want to include his bank statement
- my tenancy agreement in UK (that will be after i get a job here and rent something.... :( )
- my bank statement from UK
- our tenancy agreement from Lagos
- Letter from our land lady in Lagos stating that we have been staying together in the rented apartment
- my flight bookings to Nigeria
- my old passport with all the visas to Nigeria
- my residence permit from Nigeria (with my husband's name on it as a sponsor)
- our conversations (email, skype, whatsapp)
- Letter from my parents stating that they approve the marriage and that they have been in touch with my husband through phone and emails
- Letter from a British girl residing in Lagos stating that she knows us and can confirm that we stayed together etc
- Letter from my husband's brother who is a Nigerian but also an EEA citizen and he has met my parents and so on
- Letter from our close friend (Nigerian with Briish citizenship) who stayed close to our house and we used to spend time together in Lagos
- our pictures before and after marriage
- pictures of my injury done by the robbers
- Hospital report after my injury
- Police report after the robbers attack
- invitation letter from me
- confirmation letter from me (explaining our relationship and confirming that we have stayed together)

What else do we need? And how to go about our challenges? Thanks so much for your help

Have you actually looked at the requirements for an EEA permit? You are completely over-egging what should be a very simple pudding. 99% of what you have listed is completely unnecessary and superfluous.

Yeah, sure, I did go through the requirements. I am following the directions of other Nigerians who applied for the permit before. Some of them have been refused several times but got it only after providing enough evidence proving that the marriage is genuine...

Lucapooka So what documents would you advice us to provide? And how would you go about our challenges?

The process is the same for everyone. There is no special treatment for Nigerians. It would be better if you ignored their experience and simply make your own application on your own terms.
