CW will definitely want the original WP document to check in the System. Don't give too many documents, they will ask questions. Give only what is required. Good luck with your ILR. Please post your Experience.

I am in a similar situation (WP/Tier 2), and I have a question regarding the WP document. The only thing related to the WP I have is the letter from 5 years ago. Is there another WP document that I should present?

Re: ILR Document Checklist - Tier 2 ICT route

Post by vspv » Mon Apr 22, 2013 2:49 am

Hi Kevin,

I fulfill all the requirements and also have WP letter that was issues 5 years back. I have Visa for continuous 5 years but if you see Tier2 ICT (22.09.2009) was applied from India though earlier Tier 2 was still valid. between July 2009 to Oct 2009 I was in India and was paid Indian Salary for 3 months(90 days gap) as I was moved back to India.
Q1: Do you think after seeing first WP(seems a must have doc) the CW will get to know that all the extension were not taken from original WP, and there was a Tier 2ICT applied from India? could this be a reason to reject the application?
Q2: since I was not paid UK salary for 90 days (though I was paid Indian Salary during this period for same employer)will my application be rejected?

Visa details as below. Continuous gap -90 days. Total gap 175 days in 5 years

Visa From To
WorkPermit 20/04/2008 20/10/2008
Tier 2 ICT 01/10/2008 20/10/2009
Tier 2 ICT 22/09/2009 30/10/2012
Tier 2 ICT 01/11/2012 02/11/2015

Dear VSPV,
Since your ICT was applied before Apr'2010 you should be OK as far as you have NO gaps in visas. You need to get employer letters explaining your absences and your SOC code, job title, continued employment etc..
Good luck.

Agreed. But your Employer need to give a letter confirming why you were paid in Indian Salary? Also regarding your 3 months in India. Definitely this salary won't be in the P 60 for the that year. Whether Cw will reject or not I do not know. As long as you could explain and the Employer letter backs you up.If only asked by CW only you need to be prepared well.

Thanks Kevin24. Yes, its always good to get this confirmed on letter from Employeer.

VSPV - Note, please do not handover this sort of letters or backup things until CW specifically asks for it. I think you have fair chance but finally it depends on CW and provided you meet all other rules as applicable as on your application date.
