Passport and documents after visa application is refused

Passport and documents after visa application is refused

Hello everyone,

My visa was refused a week ago, I have appealed and I haven't received my passport (expires today) and documents back yet, does anyone know how long it takes or is there a number I can call to find out. Has anyone else received their documents after refusal.

Yes Penny, your passport will be given back to your lawyer if he/she request for that or when your appeal is allowed or rejected, did you appeal through lawyer or on your own. my visa was also refused after 7 months was just given the refusal letter & appeal application.. I have not received the documents back

Thanks for the reply. I have a solicitor and will speak to him about my passport as it has expired. Sorry about your refusal and best of luck with you appeal.

They have not returned my passport back because I have appealed.

Since Recently they are not returning the passports, all the documentation is sent to the appeals department from there they will keep tracking the developments of appeal. then upper tribunal and so on.

After you exhaust all routes they then will see what you would do in next 28 days like file a fresh application and so on.
If you don't then they will give your file to the third party they recently contracted who will get in touch with you about your departure from UK and see that you will have all your documentation given at the airport and make sure you have left.

They do not want to loose anymore people in the system, so hence this new way of tracking people from start to finish.

That's what my solicitor told me as well, my passport expires next month and I wanted to get it renewed, but ukba won't return it, now I am worried that by the time my appeal is decided I won't have a valid passport. But what can you do.

Do not worry about Home Office, they do not care about the validity of the passport. If your appeal is successful you will get all the documents back, If not you still can make a fresh application within 28 days even though your passport has expired by then.

Check with your Embassy / counsulate, most countries you can renew to a maximum of a year after the expiry.

Here problem is - If some one's entrepreneur visa is refused, then to apply for student visa - we need CAS from University - To get CAS from university, we need passport to be shown at university.

With out passport , we can not get the CAS from university , then we can not apply for different category tier 4 student application.

Could you please give me your inputs on how to get the documents quickly from home office to apply for student category application with in 28 days from date of tier 1 entrepreneur refusal.

In this kind of situation, I do not know what to advice. If I were you, I would send an email to the case worker who decided the case explaining the same and also point out that Lack of passport you cannot get CAS, and without that you cannot apply student visa. . If they have given their full name on the refusal letter then it would be
FIRSTNAME.LASTNAME@UKBA.GSI.GOV.UK.

Hi Guys

I have applied for tier 2 visa 2 months back but it got refused due to low salary as per my job code. I wrote a letter for reconsideration but did not heard anything from them. After 1 month, I received my documents but have not got my passport. I still hold valid visa for 20 more days.

Every time I call UKBA helpline they give me different answers. Some say you must get the passport back and some say we do not send the passport back.

I want to reapply for tier 2 visa with new CAS.

Do they send the passports back if application is refused? I want to apply in premium service now, can I apply in premium service without the passport as UKBA is already holding my passport.

immediately write to your case worker and asking them to confirm by writing that if they are retaining passport and the reason. and if not retaining request to send it via tracked service. In case if you apply withour passport and refused then you may have some thing to show the reason.
