Passport Returned....

Well guess what just happened... 21:00 on monday night...

Just had some guy from Home Office knock my door... The passport which they have refused to return to my wife for well, years... has been driven down from liverpool!

Goes to show how wrong they were to hold the passport? - and they must of been crapping it a bit to drive it down personally to deliver it? - otherwise why didnt they simply post it using track n trace...

-- so first thing tomorrow, we are trotting down to london to renew wifes passport in new name, and then going to get Irish visa sorted... (six months time all our problems should be sorted by the looks of it...)

Wow! This is amazing! Congrats on getting such unbelievable result from insisting on your rights. You indeed teach how to be fearless and be persistent. All the best in Ireland and indeed if and when you decide to come back to the UK.

well like I said, the fact they delivered it IN PERSON makes it all the clearer...

However, I think that they may have done that to assess if I am indeed "dependant" upon my wife?

My wife signed her complaint to ICO in regards to UKBA failing to keep accurate records though. - An offence which can provide the route to compensation...

I think the reason was that I clearly outlined to them that if the passport wasn't returned, I would begin JR on the basis that they have withheld the document. As far as I know the only caselaw on such is that of the Fishermen... UKBA surely don't want to have yet more caselaw adding to prevent them with their illegal actions.
(its prob why they also "suspended" my wifes reporting until July... - because as my email and my assertation said... whilst an application is in process she is here on the EEA regs, which do not aquire the need to sign ETC... [ unlike the Immigration Regs 1971 :) ]

We are going to London tomorrow. The passport should take about 10 working days. (no appointments needed... and for the huge sum of about £20 its not bad [cant remember the exact, but its not much more if it is more]

Irish visa can be applied for by post.

They will issue a decision on my wifes DRC this week. (which im certain will fail - but oh well)

Me and the wife have had a few discussions, and think a nice holiday will do her well... (will mean I can find a job In ireland before she joins me there) - so we will tell the UKBA to issue removal instructions for her and the kids upon that.. - surely this will engage Zambrano? - but as we have no money - they would have to fund the flights ETC... :)

She can spend a few weeks with her parents ETC. I can go find a job [rough it in Caravan for a few weeks or so].

I have a friends house where I can register for PPS no, bank account ETC.
(and have a "job" with them) - but we are indeed looking into relocating after the chats.

ahh, Dammit... Just looking again at the renewal for passport, and relised the following: Wifes passport has expired (this one was 18th March 2013)...

So by the actions of UKBA, my wife has an additional penalty of £20 to pay, due to failing to meet the deadline of renewing her passport before expiry...

So, recon the UKBA will pay this fee? - wouldn't of been payable if they had returned it upon request the first time...

This is just to confirm that the expired document for my wife has finally been received. I was quite impressed that somebody delivered the document in person to our door at 9pm this evening.

As my wife was unable to replace her Indonesian Passport before it expired, there is an additional charge of £20 to be levied by way of a fine. The way that I see it is this: UKBA failed to return my wifes passport upon request. UKBA are responsible for the damages caused by such actions.

So as I outline: My wifes passport renewal will incur the charge of an additional £20 due to the unlawful actions of UKBA staff. I see following on from the previously mentioned case (R (on the Application of Atapattu) v The Secretary of State for the Home Department ) that conversion is therefore possible...

As such I would expect this additional charge (without prejudice to other issues) to be met by UKBA...
