Post by Emrah » Thu Apr 25, 2013 11:15 pm

Im a Turkish person on my BRP it says no public funds. but here it says a Turkish citizen can get;

Turkey
 Attendance allowance
 Carer’s allowance
 Child benefit
 Child tax credit
 Council tax benefit
 Disability living allowance
 Housing benefit
 Income-based jobseekers allowance
 Income related allowance ESA (IR) – formerly income support
 Personal independence payment
 Social fund payment
 Universal credit
 Working tax credit.

is this for settled Turkish people or any Turkish citizens?

Im not getting anything anyway but Im just wondering.

Yes, there are special arrangements for those from certain countries. In this case Turkish nationals can claim certain means tested benefits if in the UK legally, even if subject to immigration control and certain disability benefits when legally working in the UK, even if subject to immigration control.

Hi there,
I have a similar case; I have Turkish worker visa but my BRP came with `no public funds`.
Recently applied for income-based JSA and refused. My appeal has been rejected on the grounds that my BRP has `no public funds` endorsement. However gov.uk web site clearly states that Turkish nationals can access to certain public funds due to exception. Can anyone comment on my best way forward please?

Ask for a mandatory reconsideration of the JSA decision within one month of the date of the decision (on the letter). Write to the office who made the decision and explain that as per the European Convention on Social and Medical Assistance (ECSMA) and the European Social Charter of 1961 (ESC) you as a Turkish national can claim IB-JSA if you're in the UK lawfully, regardless of restrictions placed on your leave.
