Spouse Visa financials Advice

Post by bes » Sat Apr 27, 2013 9:55 am

Can someone please advice If I quality to apply under cat B section 1 plus D (savings)

I have an annual income of 13k and savings of 27k. can't apply based only on last 6 payslips as some of the payslips are below minimum requirements and could require more savings, but the annual income April 12/13 is 13k including to bonus and overtime.

Is there any other Catergory I could apply?

could someone please explain the difference between CAT B section 1 and 2 as I'm quite confused

http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary

5.3.8. So, under Category B, the assessment of the financial requirement is based on:
(1) The gross annual salary or income from salaried or non-salaried employment at the date of application. This source can be combined with Category C: non-employment income, Category D: cash savings and Category E: pension; and
21

(2) The actual amount of gross income received from any salaried or non-salaried employment in the 12 months prior to the application. This can be combined with the actual gross income received from Category C: non-employment income and Category E: pension over the same 12-month period. Category D: cash savings cannot be used under (2).

thanks guys

if you have any saving of more than 16K and you have proof that you held this saving in your account for at least 6 months prior to your submission date, Then you do not need to prove that you earn £18600. Your saving of more than £16K will qualify you to be able to apply.

pls refer to page 36 on this document.

http://www.ukba.homeoffice.gov.uk/sitec ... FM-1.7.pdf

this is what it says

An amount based on the cash savings above £16,000 held by the applicant, their partner, or both jointly for at least the 6 months prior to the date of application and under their control can count towards the financial requirement where applicable. (£16,000 is the level of savings at which a person generally ceases to be eligible for income-related benefits).

Are the earnings Gross figures? Are you disabled?

I assume this is salaried income. Therefore, in last 6 months £950 can be used. Savings income = 27000-16000 / 2.5 = £4400 per annum. £950 * 12 = £11400 + 4400 = £15800. That's under the threshold. If non-salaried income then average of last 6 months x 12 = £12642 + £4440 = £17042 also under the threshold.
