Dear ALL:I have some problem in appealing against decision on Entrepreneur application.your answers may help me out of the problem,which is appreciated,indeed.

1.Application under Entrepreneur T1 (Team) 16/01/2013 from 50k
2.Refused on 22/04/2013.
3.Funds third party.

(a)which kind of appeal oral-or-paper is better?
(b) what grounds are suitable/perfect please advise what is/are suitable?
(c)what is ONe-stop-warning-Statment of additional grounds:?
(d)what should be ticked at section B of the appeal form IAFT-1-Page2,(sponsor-your representative-witnes)---if I have no represenative/sponsor/witness and appearing myself before the Tribunal...

Hello Tuliprose:Thanks for your reply:The reason for refusal is that of insufficient evidence in funds and business trading:and refused the application under paragraph 245DD of the immigration rules as you dont meet the requiremetns at paragraph 245DD(b).

we have provided bank letter,bank statment,legal representative letter in support of our claim for the funds and further for business is trading we have provided yell.com and gumtree ad materials and correspondance with clients through emails;but it is in the refusal notice that yell.com is not suitable as it provides no detail about the service we provide.Further there is nothing included in advert material about our job and name and contact.

Hi sorry to hear about your refusal, my application was also refused under the same paragraph of the immigration rules because I did not provide a contract showing trading. I can't see that you provided a trading contract in your list of documents submitted above, you must provide under Appendix A, along with all your supporting documents you mentioned ;
(iv) one or more contracts showing trading. If a contract is not an original the applicant must sign each page of the contract. The contract must show:
(1) the applicant's name and the name of the business,
(2) the service provided by the applicant's business; and
(3) the name of the other party or parties involved in the contract and their contact details, including their full address, postal code, landline phone number and any email address.

I hope this clears things for you.

we have provided every evidence in regards to the funds availablity and business contracts correspondance with clients through email:I think they were sufficient but when they wre to refuse they would be insufficient:for example:
funds from third party: his bank satment showing the reserved amount in excess,declartion from third party..lawyer confirmation of validy of documents and signatures;and bank letter mentioning avaiablity,transfer of amount plus the bank regularity body.

penny:: have you filed an appeal or did you make fresh applicaiton?

Thanks Rehan:no I didnt provide any actual contract but these were correspondance between me and the clients about price quotes,but now we have reached to make a contract....

Hi u can appeal ofcourse but I think u have to make some solid ground as u didn't provide contract n this correspondence wasn't a requirements so as my understanding valid reason of refusal ... But if u can sign contract back dated than it might be helpful in appeal tht u were in negotiations and than sign after.

My solicitor did my appeal and I don't know the grounds he mentioned, I will suggest you get professional legal help as well as its quite technical and you want to maximize your chances of succeeding at the appeal. Sorry couldn't be of much help.

i have applied T1 PSW 50 K route both team members have 25k each
applied 22feb
bio done 01 march 2013
team member partner bio done on 17 march
still no reply

question is can i take few 1000 pounds out like from 50 k can i withdraw 10k
even i applied in 22 feb2013 and if i produced invoices from my accountant so where is spend or invest like pay my buisness rent ,pay bills , or buisness car insurance or even pay for a vehicle relating to my buisness
is there any problem as my visa still in process ?
plsease reply as i need to withdraw some on coming tuesday
