Need Help for Indefinite Leave to Remain

Post by MikeL231 » Sun Apr 28, 2013 7:04 pm

Hello everyone,

My wife came to UK on August 2011 on spouse visa. She will be applying for Indifinite leave to Remain. I am not sure will she require the £18600 financial requirment or will the old rules apply because of the transitional period, she is dependent on me. Also if the financial requirments are not met what will happen?

I appreciate your advise and many thanks in advance.

Your wife remains under the old rules, which means that the post 9th July 2012 financial rule doesn't apply.

From 28 days before the 2 year flr(m) period ends.

earliest is 28 days before you wife visa expires.

How much is the current financial requirement?

Do you mean under the old rules? If so, there is no financial requirement per se, but you must have adequate funds without recourse to public funds, this means the income support amount for a couple plus any children. Under the new rules, the starting threshold is an income of £18600 per annum gross, considerably greater than the old rules.

I assume you are under the old rules (pre July 2012) if so, you have nothing to worry about, regarding maintenance.

The rule is that the application can be submitted no earlier than 28 days before the 2nd anniversary of the date of arrival in the UK...and no later than the visa expiry date.
So 28 days before the equivalent date in August your wife entered on her spouse visa.
If you're still unsure, post the date of your wife's arrival and I'll give you the exact date.
