ILR after 10 years

Post by KAJI » Sat Apr 27, 2013 4:36 pm

Hello friends,
I came to UK in 2004 as a student. I got married in UK and my wife was also a student. I mean we were both students. In 2009, I went back to Home country and applied as dependent of my wife and got visa in 20 days and returned back to UK. Now in 2014, it will be 10 years. I changed my status from student to dependent. So my question is' CAN I APPLY ILR IN 2014?' OR NOT?... Please reply

If you left the UK before your visa expired, and returned within 6 months with new visa, then you are eligible to apply for 10 years.

Hi z18runway, Is there any condition of when the new visa application /entry clearance must be made?

I mean if one leaves UK before current visa expires and returns within six months with new visa but this second entry clearance application was made about 40 days after the expiry of last visa due to maintenance of funds for 28 days, does that reset the 10 year clock or the previous stay in UK be counted for ILR?

Many thanks and Best Regards,
