I would appreciate help in regards to my situation! Please!

Also if anyone who has had a similar experience to mine, if they could shed some light on the questions I ask, I would appreciate that as well.

I'm currently on a YMS Tier 5 visa from New Zealand, date on visa - 29/09/2011, entered UK on 02/10/2011.

In 5 months my YMS visa will expire and I'm looking into applying for leave to remain in the UK as an unmarried partner - as the reason I came to the UK was because of a girl.

Now, I wish I could understand the whole process myself, but it’s not very clear.

Question One: Am I allowed to apply for an unmarried visa by coming to the UK on a YMS Tier 5 or did I have to come over on a 2-year unmarried partner visa?

Question Two: My visa will expire 3 days before I have reached the 2 year requirement needed, does that mean I am unable to apply and be successful? Does 3 days really make such a big difference?

Question Three: With only having 5 months left on my current visa, what happens if a decision has not yet been made, and it has passed the expiry date on my current visa? How much time can I remain in the UK?

Please, please help answer my questions:

1) Can you apply for FLR(M) or SET(M) from a Tier 5 YMS visa?

2) Being a few days short of the 2-year requirement, will this make it unable to apply and be successful?

3) How long after a visa has expired can you still remain on that visa while you wait for a decision?

4) What should I apply for in my situation - FLR(M) or SET(M)

Any help would be appreciated so much!

So I just thought I'd give the border agency a call to ask them one more time..

At the end I was told that my nearly 2-years on the YMS Tier 5 visa would not count as living with my partner, so therefore I cannot apply for ILR - SET(M)?

Was he correct in saying this?

Yes, FLR(M) first. No guarantee it'll be successful, but you can't apply for settlement because you'd need the initial approval first and then 2 years later you could apply for settlement.

It's now a minimum of 5 years instead of 2 before ILR.
