8 Years Study Limit? Can I do ACCA after University PGD ?

Hello fellow members,

I need some information regarding total study time a student can study in UK.

I came to UK in March 2004 and studied few courses in private colleges.

I got IGS visa in May 2008 till May 2009.

I switched back to student visa (rules placed before 31st March 2009) in Mar 2009 and completed my MBA from UK University in December 2011.

And switched to Tier 4 for MSc from UK university, got leave to remain till May 2013.

But due to medical reasons, i could not submit my dissertation and have completed Post Graduate Diploma.

Just want to know, if I can study further to do ACCA?

I have got unconditional offer letter from a Highly Trusted college for ACCA, but I am not sure if current rules regarding total study time allow me to extend my leave to remain in UK?

Your opinions will help me to clear this confusion.

How many years have to you spent studying at degree level on tier 4 or student visas?

According to me, you have finished 5 year degree level study limit.

You got IGS in 2008 so you must completed PGD or some Level 6 course which usually last for 1 year or above.

After that from March 2009 to May 2013 you spend all time on master degrees, which is more that 4 years.

If I am right on above you have already crossed the degree visa limit.

I think you should'nt count degrees time. You should count the total visa period which been issued on degree courses or time you officially declared spent on degree level courses.

93. If you are 18 years old or over, you are allowed to spend no more than three years in the UK
studying below UK Bachelors degree level in your lifetime. We cannot approve new leave for
you to study below UK Bachelors degree level, if you have already been studying below UK
Bachelors degree level for three years.
94. These three years can be spent studying one course or a number of courses.
95. This three year limit does not include any time that you spend studying below UK Bachelors
degree level under:
• the student rules that were in place before 31 March 2009; or
• Tier 4 (General) when they were 16 or 17 years old; or
• Tier 4 (Child) when they were aged 17 years or under; or
• any other non Tier 4 category which permits.

your cap starts from when new tier 4 rules were placed not before that.
so you did not spent 5 years so far on degree level.
I also came in 2004 and on student visa.

Why are you quoting the rules on below degree level study? The 5 year limit on degree level study includes time spent on pre tier 4 student visas.
