Change of employer/ dependent LR

Post by Mas2012 » Mon May 13, 2013 9:10 am

Dear all
I appreciate if anyone can guide me to the relevant information about my case described below:

I have changed my employer recently and received my new BRP and started my new post. In my previous tier 2 leave to remain I had 2 dependents, my husband and my son. I used premium service for my application as well as my husband, and thought I would do my son using postal service later.

Now the question is I will be applying for my indefinite leave to remain in 6 months time and my son has a valid leave to remain (from my previous tier 2 status) till that time, should I apply for him because I have changed my employer now or can this wait till the whole process of ILR begins? What is the legal implication of this. Obviously I prefer to do it later simply because of costs involved and time for the whole process through postal service.

Thanks
Mas

Hi there
I meant I changed my employment and obviously I had to go through a new in-land tier 2 application and did not put one of my dependents (my son) in my application, so I have new BRP Card with new employment
Obviously my son's BRP still exists, but with previous condition. In 6 months time I will be filling for an indefinite application and I thought I could include my son in that application. However, I have doubts if this can cause any problem.

Mas

Now that you have changed your employer & received a new BRP, I'm assuming your ex-employer may have already requested cancellation of your previous visa.

In that case, your son's visa may no longer be valid. Perhaps you may soon receive letter from UKBA on his leave curtailment unless you get his new visa done.

Not sure if you would want to run a risk of not getting his visa changed before applying for your ILR. I understand it's a time consuming & costly exercise.

I think you may risk your ILR application too.

Thanks very much, you are perfectly right,
I am going to apply now, would that be a problem with slight delay after us?
I have just started my new job last week, if I send the application tomorrow for him, do you think will I have problem?
