Settlement visa for new born

Settlement visa for new born

Hi All,

My husbands ILR visa and I am holding FLR visa valid til 2014.
Our baby born in India planning to apply for a settlement visa from India.
If both of us doesn't hold ILR can she apply for settlement from India , which is for two years.

I am eligible to apply for ILR once back to UK. On FLR visa I have and exit more than 10 months now. Reason for leave is maternity and father ill health condition. To reach back early I applied for visiting visa for my child and got refused stating we both a valid leave to remain and intend of applying visiting visa for baby is not genuine.

Please help me to with ILR and FLR can my baby apply for settlement visa or dependant visa

What is the current category of your FLR?

On what basis did your husband get ILR?

Husband got ilr after completing his 5 years stay in tier 1 visa . Our marriage probation period did not complete two years so I couldn give fr ilr and where asked to give flr.

If you hold FLR(M), then child may apply for a settlement visa. Leave granted will probably be in line with yours.

Is there any rule like if both of us not in ILR child cannot apply for Settelement. My agent asked me to apply for settlement visa along with child from India. Is it required ?

An application is not necessary for you, if you already hold a valid unexpired FLR(M).

So my daughter can apply for Settelement visa with my flr m category.

Thanks for ur response. We made a mistake applying for visiting visa.
And got refused stating parent on ilr , child is eligible for settlement and we trying to get in to UK visiting visa route.
