Husband on Pakistan Settlemen Visa- Life in the UK Test

Post by Exquisit33 » Wed May 15, 2013 3:23 pm

Hello,

My husband applied for Settlement Visa June 2011, it was refused and decision was overturned December 2011. He then came to the UK in February 2012.

1) My question is as he will be applying for ILR next year.. What tests are mandatory for him to undertake or courses in order to meet requirements of ILR application.

I am really confused about Life in the UK and ESOL???

Also I notice there will be changes: Changes to 'knowledge of language and life' requirements

19 April 2013

From 28 October 2013, unless they are exempt, all applicants for settlement or naturalisation as a British citizen will need to meet the knowledge of language and life requirement by:

passing the life in the UK test; and
having a speaking and listening qualification in English at B1 CEFR or higher, or its equivalent.

2) If my husband sits the test before the changes come into effect i.e this July 2013, but applies for ILR next year does that mean he will need to re-sit new test as he will be applying after the changes have come into place?

3) When applying for ILR would we need to send off documents with both our names.. i.e Joint Bank accounts? or individual?

Thank you in advance for reading and answering my post.

Does your partner have a degree taught in English? If he sits the life in the uk test now it will be valid indefinitely and he can use it when he applies next year. However, he will also need the English B1 qualification, hence, why I asked about a degree taught in English.

The documents to prove cohabitation for set(m) must be over the 2 year Probationary period (roughly for each 4 month period) and must be 6 letters in joint names or 12 single names (one each x 6) or a combination of both from at least 3 different sources.

No my husband does NOT have a degree taught in english. He only did the test speaking and listening just before he applied for Settlement Visa.

Then he needs to make sure he has a speaking and listening qualification in English at B1 CEFR.

My husband has been here since February 2012, however we were not aware that for ILR documents need to be in joint names now I am worried what will happen.. officially we are living with parents so bills are under their names. I am really worried as we have no proof of living together..

What letters do you have over the two year period? In either single names or joint names?

Split the 2 year period into 4 monthly periods (6) then see if you have a letter each for each of the 4 monthly periods and in total from at least 3 different sources. The letters you highlight are good sources, it's the date on the letter you should be looking at.

Ok thank you, I will check.
Also my hubby did an EMD test speaking and listening in Pakistan before he applied, does he need to still have b1 cert? As we will be applying next year.

See https://www.gov.uk/government/uploads/s ... t-koll.pdf pages 5&6 for what can meet the English Language requirement.
