When a friend of mine went to apply for the Fiance visa last year, cheeky as he is, he asked the ECO whether he can apply for it and head back to the UK on his existing LTR and come back and get the passport endorsed with the Fiance visa incase it has been approved... so that incase it doesnot get approved he can stay on and become illegal overstayer.. he doesnt mind as long as he is with his would-be wife.
Strangely, the ECO saw the humour in it (his word, not mine) but said that once an application is pending, the old status cannot be used to enter the UK. If the application does indeed get rejected, his status reverts back to the one that he already had and then he can head back to the UK on the LTR and then do what is required if the IO lets him in... (to become the overstayer?)
Even though I doubt his boldness, I see no reason to doubt the basics of his information!
