Travelling to Spain with 4eufam

Post by iamanalien » Fri May 31, 2013 10:08 pm

Hi people,

I'll be travelling to Spain in a couple of weeks with my English wife.

Will the immigration at Malaga airport allow me to enter without a visa but with the required paperwork - passport, 4eufam, marriage certificate etc.?

What are they like these days?

Any advice?

Kind regards

You can go with your 4eufam marriage certificate and passport and your wife. You would hv no problem what so ever. To be honest Schangen states are very good according to implemention of eu law, So dont worry
Enjoy ur time.

Thanks for your reply Diamond...

I browsed a thread 4eufam and EU wide Travel and whilst I agree with you, I read that UK is problematic and Spain a bit confusing.

I'm pretty confident that it will be okay but my wife is a bit worried so I want to reassure her.

Do you know of anybody in my situation that has traveled to Spain without any hassle.

Kind Regards

Yes , i know some people ,who have travelled to spain with 4eufam, without any problem, Me personally have travelled to holland ,portugal with 4eufam, So do not worry , if they ask something extra , remind them directive 2004/38/ec. Only UK is denying these rights of family members of eu nationals , rest of the eu including Ireland accepts family members with RC.

Your wife has an article 10 residence card. Spain's laws explicit allow such holders to travel without a visa (in line with directive 2004/38/ec).

Have you looked at this thread?

Thanks for all the replies. I feel confident that the trip will be a success and I promise to update the thread that EUsmile.... posted.

The spanish government do state on their uk embassy website that british 4eufam rc card holders will be allowed through with their spouse but this info does not appear on the ireland embassy website for people with irish 4eufam rc cards. I think that this is probably an oversight.

Once again, thank you for the replies.

Kind regards.

in fairness, they are trying to supply information to those that are interested, not to every possible case.

Article 10 residence card means no visa.

I found this on their dublin embassy website.

C. FAMILY MEMBERS OF EU CITIZENS
Family members within the meaning of European law are, irrespective of nationality, the spouse and descendants of these persons dependent on them, as well as the dependent relatives in the ascending line of the person and their spouse.
Only holders of 4EUFam residence card will be exempt of the visa requirement provided they accompany or join the EU-EEA citizen

http://www.exteriores.gob.es/subwebs/Em ... ments.aspx

It should be fine. I'll take a screenprint of that page with me plus all the relevant documentation of course.

Kind regards.
