Dependent ILR--need advice URGENT

Post by Navi123 » Wed May 29, 2013 11:53 am

Hi,

I will apply my (10 yr )ILR this yr, but not sure about my dependents route to ILR.

!-MY wife and children joined me in nov 2010 as Tier 1 dependents, they applied for extension same time as me in 2013.
2-I was renting for last two years and had no document for cohabitation apart from tenenacy agreement or a letter from GP. MY own documents were redirected to that address for that period.

Questions-
1- Can i apply for my wifes and kids (kids were not born in uk)ILR once i had my ILR, if yes then is it by using form SET (0)?
1.1-if i cant prove cohabitation can i apply for my kids only (not born in uk, but living wiht me from nov 2010)?
2-what options do i have to prove cohabitation..as it is clr i do not have enough docs to prove.
3-if i dont apply for my wife and kids ILR straight after i get my ILR, can i apply for theirs after current leave to remain expires in 2015 (Tier 1 ext)?

any advice and help is highly appreciated.

Collect as many documents as you can.

No, if their leave hasn't expired. They should make an application before their leave expires.

Thanks Vinny,

Can you also please confirm re the form i.e. which one i should use for my dependents (FLR (m) or SET (0).

As per my conversation with some solicitors, some say that they are dependent of Tier 1 and when i change my visa to ILR their's will become invalid after 28 days

is there a link available where i can clarify this info (i.e. no need to apply for my dependents ILR if their current Tier1 is valid)?

Why not do some leg work yourself?

Just explore the UKBA website. Read through the rules and guidance. Its your application, you do the hard work. If you want someone else to do the hard work, then pay a solicitor.
