Travelling to Spain- Indian spouse with Residence Permit Q's

Hi,

Please if someone could assist me as im confused.

I am a British Citizen and married my Indian Spouse 5 years ago.
We are travelling to Spain next month for my sons 3rd birthday.
I am aware that he may travel without a visa as he has a Residence Permit in his passport, however this only states 'Settlement' and 'Indefinite Leave to remain in UK' - nowhere does this state 'spouse' or that he is my family member.
However it does say Spouse on his UK entry clearance in his passport which is dated 2008 and has now expired.
There is no way we will be able to obtain a Schengen visa in time to travel on 9th July as there are no appointments.

Was he given an incorrect Residence Permit?? We have had so many issues with visa mistakes in the past that has cost us dearly to fix.

Are we going to be able to go away??

He was not given incorrect permit. You have been reading about "family member of EEA national" thing on spanish embassy website. This endorsement is given to non-british-eu-citzen's spouse.

This is irrelevant for you, as your situation is covered by UK immigration rules and not by eea regualtions.


Are we going to be able to go away?
Most likely not.

Ayyubi72 is correct. You will need a Shengen visa. The airline will not allow your husband to travel without one.
