I had my application for ILR 10 year route rejected by the home office on 04-Jun-2013 on grounds of not meeting the requirements of long residency specifically unable to demonstarte 10 years continous residency under Paragraph 276D with reference to Paragraph 276B(i)(a) of HC395 with the right to appeal. I was deemed to have been without a valid leave for a 69 day period between 01-Nov-2003 and 08-Jan-2004 due to making an out of time application on 29-Dec 2003. This due to problem in acquiring documents from back home due to a family bereavement.
I first entered the UK as a student on 18-Sept-2002 and have had the following visas
01-Sept-2002 to 31-Oct-2003 (Initial entry clearance)
09-Jan-2004 to 30-Nov-2006 (Student visa extension applied on 29-Dec-2003)
14-Mar-2007 to 31-Jan-2008 (Student visa extension applied on 02-Dec-2006)
17-Feb-2008 to 31-Jan-2009 (Student visa extension applied on 24-Jan-2008)
09-Aug-2009 to 10-Aug-2011 (Tier 1 PSW granted on appeal 16-Mar-2009 after initial application on 07-Jan-2009 rejected)
19-Mar-2012 to 30-Jan-2013 (Tier 4 Student visa applied on 10-Aug-2011)
I was wondering what my chances are of success in an appeal and curious if others have had experience of having such gap in eligibility period. Thanks in advance for sharing and advice.
