ILR Eligibility

Hello All

I have gone through the ILR eligibility criteria and also "Indefinite leave to remain – calculating continuous period in UK" document in the UKBA website dated 6th April. However, I am still confused as to whether I am eligible to apply for ILR now as the 180 days absence aspect and the initial time between entry clearance being issued and applicant entering the UK within 90 days period are not very clear - does this 180 days include the 90 days or is it excluded. I have so far been out of the country during my visa validity for about 200 days (85 days between visa / entry clearance issued date to date of entering UK and 115 days in holidays over the last 4.5+ years)

My visa and extension details are as below:

- Date of Issue of Visa: 24th June 2008
- Entry to UK: 18th Sept 2008
- First 3 year period: 24th June 2008 to 24th June 2011
- Extension period: 13th June 2011 to 13th June 2013 (So, have just about 1 month left)
- On Holiday in India between 18th Sept 2008 till date: About 115 days - 4 trips in the last 4.5 years, each trip lasting between 25-33 days.

Am I eligible to apply for ILR in next 2-3 weeks or so.

Any suggestions / thoughts and feedback is very much appreciated.

you have 2 days left unkless you plan to apply as an overstayer in the 28 day grace period.

You should never aim to apply as an overstayer as you may not be able to work in the interim period!
