Switch from Tier2 (ICT Short Term) to Tier 4 General

Hello ,

I arrived in UK with a Tier 2 ICT short term visa valid till Dec 2013. I found a course (which is not available in my home country)
Now i will be pursuing a 2 year Masters degree in one of the Russel Group institutions.

I am applying from within UK based on :
http://www.ukba.homeoffice.gov.uk/visas ... inside-uk/ it is understood that i can apply without leaving UK .

The course starts in 23 Sept 2013, I will be applying for visa in the first week of july ( will be crossing the 28 day requirement then).

Ive already done my Biometric to get my current visa back in Oct 2012 should i do it again ?

If some one can let me know on the things that need to be done ahead of the visa application it will be great .

Today i received my offer from the university will be receiving my CAS sooner .

You have to obtain 40 points. If your university get arranged a CAS from UKBA then you can claim 30 points and remaining 10 points you need for funds as how you can support your studies and living cost for which you need to refer the tier 4 policy guideline and your course fee to actually determine the required funds to demonstrate. And strictly for bank statement/letter follow exactly the UKBA guideline as what should be shown on it. Biometrics you have to give again and some postoffices also provide this service too.

Thanks for the response!!

Assuming My Current Visa gets expired in Oct 13 and Course starts in 23 rd Sept 13(CAS also mentions the start date of the course as same) if i go for stamping in the first week of July .

Can i continue to work till Sep 22nd ?
When does my student status come into play ? When should i legally stop working?

I've searched a lot to but couldn't get info on UKBA regarding this work to student visa cut over.

As soon as you switch into/convert to another category then the relevant visa conditions will start to apply. You can keep things simple in a way that you already book the PEO appointment near the course commencement date and until that time you can continue to use your old visa which enable you to work full time. Moreover, till the expiry date of visa and plus further 28 days you won't be overstayer and can make application within that too.

Hi ive got all my documents sorted out . I have few questions though

1) Since i will be using a bank loan from a UKBA approved bank in india . Since im applying from UK and be using a indian banks loans will there be any difficulty?

2) I want the apply through post wht will be the conservative estimate to get reply from UKBA for the same ?

3) In http://www.ukba.homeoffice.gov.uk/visas ... -to-apply/

it says

"We suggest that, if possible, you apply during the last 3 months of your current permission to stay. When we approve your application, your new Tier 4 sponsor (which has assigned your new CAS to you) will immediately become responsible for you."

I have my Tier2ICT till Oct end my course starts from Sept 23 rd and i will be working till Sept 20th .

Please let me know on how to handle this.

4-14 weeks

A Valid application can maximum be made within the 28 days of the visa expiry date, but applying as early as possible let say 3 months is always advisable. As soon as you switch/convert into tier 4 then new visa conditions start to apply.

This means that if my student visa is approved on September 1st . I cannot/should not work based on my valid Tier2 ICT till Sept 20th . This is my understanding correct me if this is right .

Is it possible request the starting date of the Student visa to be from Sept 23 rd (As mentioned in CAS) and not Sept 1 which is the date of approval ?

This means that if my student visa is approved on September 1st . I cannot/should not work based on my valid Tier2 ICT till Sept 20th . This is my understanding correct me if this is right .

I do not think two visas co-exist rather the latest visa conditions will start to apply. Usually a student can work full time during semester breaks and end of studies.
Why don't you make things easier and send your tier 4 application on or after 20th september and from 23rd september attend your class.

I got a response from my employer that once i stop working from September 23rd my Work Permit will be cancelled from their side . If this is the case if i apply through post for my Tier4 by mid august will it be a problem if the tier 4 visa comes late? will i be deemed over-stayer or as an illegal immigrant ?

Please let me know on this .
