Urgent Help on FLR(M) application !!!

Post by non_eu » Wed Jun 12, 2013 12:31 pm

My wife need to apply for FLR(M) dependent application.

Currently on : Tier 2 dependant Expiary 2014 august.
My status : ILR under 10 year rule

My wife :
1.5 years under IGS dependant
3 years 10 months on Tier 2 dependant

As per the advice from home office have to apply with FLR(M) and soon get approved straightway able to apply SET(M).

But, I couldn't find any immigration rules. Please guide If anyone on similar situation as application fees are very high don't wont to try any chance. Can I apply for my wife straight away for settlement.

Also, wanted to know how much maintenance needed as I am having two kids they have already applied via MN1.

Appreciated for your answers and guidance.

Wrong forum!

You have to apply for flr(m) first and once that is granted, then apply for settlement with set(m). You can use time on pbs dep with flr(m) to satisfy the two year requirement for set(m) as per immigration rule 287(a)(i)(d).

The old rules require adequate maintenance without recourse to public funds - an amount akin to income support once any rent/mortgage has been deducted.

I have lost the Job from the company provided tier2 and currently my wife is on Tier 2 dependant(however visa expiary shows aug. 2014), which my wife is on. I head from the employer they have informed Homeoffice in may 2013 but, for myself or my wife haven't received any letter saying that visa expiry. I am on ILR from May 2013. My previous post detail about my wife's stay and visa.

I have attended many interviews, hopefully I will get one soon. but, no idea how much annual salary will get. But, currently I have last 6 months payslip.

I am living with redundancy money received the last employer. And haven't registered for any benefit.
Question is :
1. Do I need to find a job soon to apply for my wife's FLR(M) ?
2. How much Annual salary as my wife is not working too. Between, we have applied for two children MN1 which is in progress.

Please advice as this is very urgent !!!

Appreciated !

As you're unemployed and settled you should apply for job seeker's allowance, remember to state your wife is subject to immigration control. Also, how much savings do you have? You should have also applied for child benefit (your name) and tax credits (joint names) as you have ILR

For documents see http://www.ukba.homeoffice.gov.uk/visas ... documents/

I have around 4.5k in my account. Also, my wife don't have any saving. I didn't go to any benefit as I have money to survive.

Please advice how to produce this saving.
Can I show my bank statement?
Do I need a job to apply ?
Can I keep last six month payslip from my previous job ?

Appreciated for your support .

Apply for the benefits now. The savings should help you satisfy the requirement how much rent do you pay per month?

You may be entitled to housing and council tax benefits but make sure the application only gives you a single person amount (plus kids) as your wife is subject up immigration control. Claiming benefits you're entitled to will not affect your naturalisation, see the good character FAQs on citizenship forum.

Your income support amount (adequate maintenance) will include your two children so you should be applying for the benefits. Why wait till you have no savings left?

Many thanks. Another question, my wife sat for A1 English exam on 11th of June. So, the results will take 4-6 weeks. Between, I have seen same day service available on 2nd of July. So, can I book same day service with the letter of exam attendance. It is so easy exam my wife is very confident she will pass also she has passed the life in the UK exam. This is for FLR(M).

Appreciated for all your support

You have to have the result. Moreover they will expect more savings unless you have the benefits as well, once you have your benefit award we could then consider what savings you need. You need to claim what you're entitled to as a matter of urgency.

Well this immigration rules just says 'the applicant was admitted to the UK or given an extension of stay as the spouse or civil partner of a Relevant Points Based System Migrant'

May be they mentioned about who got ILR under PBS and not Long residence .

where does it say long residence ?

The reason iam asking is iam in same boat.
