Hi members,

my question is: what does the HO need to see in order to establish that I have been physically presesnt in the UK 5 years before the date of my application? does that mean on that particular day? or does it mean having resided legally inside the uk on that date (but could be on holiday in spain for a week for example and that is ok?)

I have read the guidance notes and it says Pasport is the evedince required?

However, I dont see how that shows that I was phsically presesnt at that prticular date 5 years ago inside the uk? or is it my wrong understanding of what the question means? (passport shows when entry to uk but as we know british pors dont stamp passport when you travel out)

therefore do I also need to provide for example a letter from my employer to show that I have been employed on that particular date?!

I mean what If i was on holiday for one day on tht date in france or something? to me surely that does not mean I disqulify? sorry but can somone just explain to me what is required to show as evedince for this requirement? just passport?

There must be no evidence that you were not physically present 5 (or 3) years before, at the time the HO receive your application. If for example the UKBA system showed you left the UK for a week at the time you were supposed to be physically present, you would fail the test and be rejected.

Thanks for that D4109125... am now clear that its a specific day requirement...

So, I just need to be confident that its just the passport required.... having been in the uk (hsmp + tier 1 + ILR) for the last 6 years, I have been through a lot of HO applications and my mind is refusing to believe that its just the passport required and they will do the rest and find out for themselves the info they need?! that is just not been the case specially in ILR where I provided Covering Letter, letter from employer, pyslips, bank statements, rent contract, etc,,,, you know the drill

am also aware that the omen is on the applicant to provide necessary evedince......

what do BC applicants provide as an extra, in addition to the passport?

shall I provide letter from my employer? P60 certificates, rent contract?

please advise... Much grateful.

are there one day PO appointments with the HO (like for ILR) where application is processed same day?

also I am aware of the NCS, but not sure how it works? if I book an appointment with them, will they expect that all docs required is ready and I bring on the day of the appointment? or is it at the appoinment that they would tell me what exactly is required and advise if something is missing?

again can I get some advise of what applicants send with their application as supporting docs apat from passport? and what is not necessiraly asked specifically in the form...

You take all your documents and they check your application, make photocopies and give you the originals back. They send your application to UKBA. They charge a fee, so best would be to take everything with you so that you don't have to pay for the serivce again.

I used NCS and supplied my passport, hubby passport marriage certificate, LIUK certificate, latest P60, BRP but applied as spouse of british citizen and got approval in 6 weeks
