ILR dependent for spouse and child

Hi,

My husband has ILR since November 2011, my daughter and I have been in India since Dec 2010 as we had to move here due to death of my inlaws. We lived in UK from Jan 2009 to Dec 2010 on tier 1 dependent valid till nov 2011. Our daughter was born in India in 2008. i lived briefly in UK in 2007 on HSMP dependent. We have decided to move back to UK. what visa should we apply for, where is it better to apply from India or my husband applying for us in UK. what is the processing time and requirements. Will my daughter be eligible for settlement visa.

hello,

for your daughter you can apply for ILE but for yourself in need to ilr dependant which will be 3 yrs and then 2 more years of extention.

there is also financial requirment to be fulfilled by your sponsor.

Thank you Deep, so for an ILR dependent should I still be applying as tier 1 dependent visa? can my husband husband apply for both of us in the UK or only for my daughter. We do meet the financial requirement.

If your Tier 1 dependant leave has expired, then agree with CR001.
