Immigration Appeal Advice

Post by melanielr-1984 » Fri Jun 21, 2013 3:00 pm

Im sorry if this isnt in the right place but its my first time on here and i couldnt seem to find a relevant thread.

I was supposed to be a witness for my ex partner in july at an upper tribunal hearing. He has had his application refused twice and was also refused at the last tribunal.

My question is how do i become a witness for the home office or court instead?

I know this probably sounds really nasty but i believe there are genuine individuals out there that deserve the right to stay in the uk to be with their families but he isnt one of them.

We have been together for 2 years but in april he was found guilty of assulting me and a restraining order placed against him for a year. He was told to seek legal advice to see our daughter. He has been begging me to go to court to get the restraining order removed so we can apparently be a family again. I have just found out today since he was arrested he has been staying with another woman which he totally denied until i talked to her. I have refused to get the restraining order removed. I have been told that he was just stringing me along till he got his appeal through and then he was going to leave us anyway.

He has been to court previously accused of beating his ex wife and that was the reason they refused his appeal.

If someone could please tell me who to contact or write to because i genuinly believe he doesnt deserve to stay here. He has never paid a penny for our daughter and hads never fed her or changed her. Hes going to court basing it on hes my only support. Well i support myself and we dont even live together.

I want to make a statement to the home office or upper tribunal but there are so many numbers and emails dont know what to do.

Thanks in advance
Melanie

I would ensure that you continue to prevent him from having access to the child as he seems to not only be domestically abusive but also violent. You can if you wish write to the Home Office/tribunal service to explain his violence and that he is not allowed contact with the child (if that is the case) also that he does not support you or the child. Under no circumstances should you be a witness or support his case whilst he is abusive. You should cease all contact with him and his partner.
