well,if the ministry of foreign affairs acknowledged the case and they asked u to send more documents/proofs,it means they are considering the case and i'm confident that they would overturn the decision wrongly made by their embassy in kenya,they might get in trouble even so,what they did is wrong and i think the ministry will let them know,but i assume they already know that they made a mistake and i even think they did it by purpose,i think after u get the visa,u should complain against the embassy staff and the treatment you endured with your wife,they are in breach of your rights of free movement for u and your wife.Stuartb wrote:I don't know how long it's likely to take, as I said it's been about two weeks, any ideas as to how long it might take and what they're likely to do?
Well I honestly don't think that you are moving forward with wife's application. To make a long story short, it would be difficult for your wife to get an entry visa because you have been living in the Netherlands more than 3 months (unless I am wrong), and to fall under directive 2004 you will need to show that you are a qualified person (I doubt that you fit in any of the categories). I don’t wanna discourage you but maybe you should look some other parts of the country as well because you don’t speak the language and this is a huge barrier. what u said in your last message is right,if she applies for a C visa it won't take 6 month but only 15 working days,in my reply i was referring to what u said in in your previous message that i highlighted in red,if they asked u to apply for the C visa which is 90 days visa then its fine,after she joins u,u can apply for residence card right away.Stuartb wrote:Are you sure it would take 6 months? nobodysperfect wrote:The lawye can help you with your appeal alongside pushing the ministry of external affairs to grant you your rights. I had the same issue with holland and a Dutch lawyer sorted it out for me. There is no way you would get the similar response on your own.
can u provide stuartb with information/direction on how to get legal aid,if u done it ,i'm sure it could help him sort out the issue sooner .nobodysperfect wrote:You have an option to get out of the Netherlands and move to Ireland. You will not loose the right of residence for an absence of six months. I am very sure that you will receive an outcome of your wife's visa application with the Dutch within six months. If at all it id positive you can go to holland a d easily come to Ireland together. Meanwhile make your life easier and go to Ireland. I have been to both the Netherlands and Ireland and I can pretty much guarantee you that's things are much easier in Ireland.
Also base on your post you are not earning significant amount of money so you will qualify for the legal aid in holland. Get a lawyer and you will see things moving much quicker.
