Questions regarding application

Post by thomas82 » Thu Jul 04, 2013 9:59 am

I was granted my ILR on Jan 7 2012 and my wife who was already here in UK as a dependent on my Tier1 visa switched her visa to dependent[FLR(M)] visa of my ILR on Feb 7 2012.I'm now eligible to apply for my naturalization and planning to apply soon. But I have got few questions regarding it:

1. Once I'm granted my naturalization, will my wife need to switch her visa again? I believe she does not have to , could some one the forum kindly confirm this?
2. I passed[Dec 2011] "Like in the UK" test before I applied for my ILR, will this document be enough for the application of naturalization as well.Or do I have to take "Life in the UK" test again?

I really appreciate if someone would take time to answer my questions.

When was your spouse granted the PBS dep visa and has she get ILR yet? Did you apply for ILR due to long residence or PBS?

Your LIUK will suffice providing you naturalise before October 28.

My spouse was granted her Tier1 dependent visa in September 2011.She then switched her visa to ILR dependent visa[FLR(M)] in Feb 2012 after I was granted my ILR.

I got my ILR after being on work permit for 3 years and 2 years on Tier 1 General. I entered the UK on a work permit in Jan 2007, and then switched to Tier 1 General in March 2010.I was granted my ILR in Jan 2012.

Are the rules changing on October 28t? Could yopu please provide me with a link?

Why did your spouse switch from pbs dep to flr(m)?

She can combine the time as a PBS dep and that of flr(m) to make the 2 year qualification period. Prima facie she can apply for settlement 28 days before the 2 year period in August/September 2013. I assume the period from PBS dep to flr(m) was continuous.

She will need to be settled (granted ILR) to naturalise as British.

If you become British she will be able to naturalise after being resident in the UK for 3 years (and being settled amongst other requirements).

I read some where, she was required to switch from PBS dep to FLR(M) once I was granted ILR. And I also read, if she was to leave UK on a holiday she wont be let back unless she had her visa switched. Is this not true?

The period from PBS dependant to FLR(M) was continous. She did not leave the country.

Could you please confirm she can combine the time as a PBS dep and that of FLR(M) to make the 2 year qualification period? Its just because I cant find any link or article stating it.

So once I become British will she have to do anything? Can she just apply for ILR when she is due to get it?

Thanks of taking time to answer my questions, really appreciate it.

Sounds like someone at the local pub has been advising you on immigration matters

Immigration rule 287(a)(i)(d) allows you to combine the period of pbs dep with flr(m). Once you are naturalised your spouse doesn't need to do anything. However, she should be able to apply for settlement soon.
