Need help about a complicated issue...

Post by Kwame O » Sat Jul 06, 2013 6:02 pm

I already have 2 years UK visitor visa and my spouse is a British citizen. I had my 2 years UK visitors visa 6 months before our wedding. We had our wedding in our home country(Africa) and I went back to the UK on my 2 years UK visitors visa.

I would like to know whether my spouse can file spousal visa for while I am in the UK or I should go back to my home country before she can file
. NOTE: My visitors visa will expire in 2015.

I read from the UK border website that I cannot file for spousal visa if I am in the UK as a visitor.

You cannot switch visas in the UK. You will need to return to your home country and apply for entry clearance as long as you/spouse meet all the requirements.

Also, remember that you cannot live in the UK for the full validity of a visitor visa ie till 2015.
