Overseas born child_Registration as BC/Naturalisation

Post by shinojan » Wed Jul 10, 2013 10:28 am

Hi;

I have a query/issue which I have tried to get information from the UKBA website, as much I investigate into the problem I still can’t get my answer.

I had got my HSMP (High Skilled Immigrant Visa) in August 2007, based on this visa programme after 5 years I got my ILR (Indefinite Leave to Remain) Visa. During this period I got married back home (Pakistan) and got a kid born in Pakistan. My Family (Wife and Son) came in June 2011 to UK as my dependent. As rules changed my wife got a 3 years visa based on the new rule as dependent of a settled person. My son (aged 2 years and 7 months) got ILR same time and day when I got my ILR. It’s been a year me and my Son have got our ILR and I am due to apply for Naturalization in August 2013.

I called the local council and asked to book an appointment from the Nationality checking service who informed me that I can apply for Naturalisation but my son can’t apply the same time with me as his birth was in Pakistan and mother is not on a settled visa/status.

I have read and checked UKBA website but could not get a clear answer weather my son who has ILR for 1 year can apply same time for naturalisation with me or he has to wait ????

Could you please advise me in this issue what I have to do, I would also request if any specific link is to be shared from your side which would be related to my query, still do explain the procedure what is next to act upon as I have spent 5 days reading website still could not get my answer.
