Family visit visa rejected appeal help

Post by adnan111 » Mon Jul 22, 2013 3:42 pm

I am a UK national and currently living here. Married someone a few years ago in Pakistan. We have a child who has British Nationality. I want to move there in the next couple of years. Wife is also happy there and all her family is there. I want to do some business there as the country has a lot of potential and there is better lifestyle if you can make it there. I spend a few months each year there with her. Recently a relative of mine applied for my wife to visit her here. The visa was refused not because of anything wrong in the application or the sponsor but because of me!! The UKBA stated that she wanted to visit me and would not be returning???

The relative is looking to file an appeal and any advice or guidance would be helpful. I wonder if I should ask my relative to not to bother and they can keep their visa, and the relative can visit her in Pakistan instead every year or every couple of years.

Hi, It is very clear that VISIT VISA is to only visit some one in UK.
(Normally it is 6 months they use to give and in some cases they may restrict to any number of days ).

In my opinion ther is no point in going for an appeal, as you have clearly stated that her relatives said that she is visiting you and will not return to Pakisthan.

The following are the options for you..

1) Apply for a depandant Visa for your wife , so that any time she can come and meet you here...(Since the visa is rejected once, this is the best option for you even though the Visa fees are high )

2) You can try again apply for family Visit visa once again...without stating that she will not return to Pakistan.
Please update BC timeline in google docs https://docs.google.com/spreadsheets/d/ ... li=1#gid=0

I am another user just like you.....!!

No the relative did not say that she is visiting me or will not go back but the UKBA stated that in the rejection of visa.

Can someone please mention whether it would be worth appealing and chance of success or would it be better to just leave it as it is.

Someone advised to make a fresh application as it will be cheaper and quicker but no keen on the option as we feel that a blot has been put on the character by UKBA saying that my wife will not return and want to clear that, and as they have refused already pointless making a new application as I wouldn't want my wife to visit a country that didn't want her here.

Thanks

Isn't it too late for an appeal?

No she submitted her application before the 25th of June and the UKBA gave her 28 days to file an appeal using form IAFT 2.
