Section 1(3) - Simple Query

Dear Gurus or Experts,

If one of the parent gets its ILR, then the child born in UK automatically qualifies for BC under section1(3) OR both the parents first needs to be on ILR for the UK born child to register as BC?

As my wife got tier-1 dependant visa after the July 9th 2012 rules, so she is not eligible for ILR currently with me.

Its a very simple query, but I was unable to get clear answer to it while reading the guides from the UKBA website.

Your response on it will be highly appreciated.

Last question, how long it takes for the minor to apply for the British Passport after getting BC?

no need to apologise. Just much quicker to read it yourself than to wait for someone else to give you the answer.

Once BC is granted (1-2 months nowadays), it takes 2-3 weeks to get the passport (or 1 week if you pay extra).
