HMRC Penalty Cancelled

Dear All,

I have received penalty notice from HMRC as I have not filed the Tax returns for year 2011-12, the penalty notice was received in Jun 2013. I have phoned HMRC and informed them that I should not be penalised as I have never receive any income as Director of Company.

HMRC have cancelled the penalty and sent me letter to confirm that.

My question is, "Do I need to mentioned that I have issued with Penalty Notice which was later cancelled or revoked by HMRC in by British Citizenship Application?" or I should not mention this in BC application as I should not be issued with Penalty notice in first place.

I am going to "Check and Send Service" in few days and I will really appreciate your response.

Dear Amber,

I have read FAQ's but still couldn't find if HMRC penalty comes under "Civil Penalty" and if the penalty is cancelled or revoked by HMRC do we still need to disclose in Question 3.9 of AN form.

Answer is NO.

from what I understand your tax matters are up to date. do not mention it on form at all. if not sure use the NCS service from your council.

HMRC penalty is not conviction... LOL

Thanks for your reply, I have booked NCS service, should I ask them about HMRC penalty at the time of appointment OR should I phone them to confirm this.

Also just wanted to confirm that "Is HMRC penalty a "Civil Penalty"?, I know its not a Conviction.

HMRC Penalty is just an invoice.

Clear your head of this worry... its just another invoice for not filing your tax return on time ....
