Query - Section 7.11 of the SET(O) form

Greetings.

I was wondering if somebody could help me put with a query regarding section 7.11 of the SET(O) form.

I entered UK on 15 June 2008 with entry clearance granted in April 2008. I am planning to apply for ILR in July end. During the period of last 5 years, I was outside UK for 192 days in a single stretch once. From 1- June 2010 till 10-Dec-2010. However, if I count my 5 years from the day of the application, the breakup appears something like this.

Section 7.11 of form SET(O) asks how long have you lived in the UK so that would, in my case be approx 5 years and 2 months. It also asks for details of any periods of absence of more than 6 months during that time.

My question is do I need to provide details of the period where I was away for 192 days or not because when counted backwards from the day of application, I wasn’t away for more than 180 days in a year?

Please advice. Apologies if similar queries have been answered before, I searched for quite some time but couldn’t find it.

you are absent for more than 180 days. You dont qualify foir ILR with the info you have described above

The period is counted backwards from the day of application. Considering that, I wasn't away for more than 180 days in a year.

Yes, a continuous absence during your qualifying period must be reported. You cannot break it up based on the anniversary of your entry date. Your passport will be stamped with the entry and exit dates.

Good then you have nothing to worry about.

I PMed ILR_HP and he advised if I am able to split your absence to less than 180 days in a particular year then there is no need for it to be mentioned. In his case, he had absences of more than 180 days in a year so he had mentioned as yes and gave the reason as Work related.

I contacted another member who had approximately 220 absences in a year and advised me to mention it as yes and also state when counted backwards from the day of application the absences are not more that 180 days.

Just an update, I was granted ILR yesterday. I didn't mention the long absence in section 7.11 and no question was asked throughout the application process.
