Overstayers and marriage in the uk

After reading about this on another thread i wanted to start one on this subject.

Is there any procedure an Overstayer whos passport is with the UKBA have to follow in order to obtain there identity information back of the UKBA in order to be able to marry? ie do they have to ask the UKBA for a letter confirming there identity? and tell them its for the purpose of marriage?

Or try to get a new passport from there consulate?

Has anybody any experience of this?

If you're an overstayer you risk being reported to the ukba and arrested at your wedding.

But if the UKBA already have your passport and your address then your at risk anyway do the UKBA just want to stop you from marrying?

My husband was in the exact same situation as you
the home office had his passport and he was a overstayer
We wanted to get married
But there is no way you can
the home office will not help you get married in the UK if your an overstayer

My husband returned to his country
The home office returned his passport at the airport!
We got married in his country and then applied for spouse visa from his country...

My advice return to his country get married there and apply for spouse visa
If you meet all the requirments they cant refuse you

I was an overstayer but was able to marry at my parish,my little advice will be start going to church on sundays with your partner but dont inform the vicar ur intentions of getting married give it abt 6months....make urself known at church dont just go and and go back home be Very friendly try having a chat ...

Give or take after the 6month mark you can then inform your vicar,If u aré a non EU person like me he will let Uno u would need to apply for a common lineces,he will help u with that but would've to come to ur house to make sure you aré leaving together and in his parish.If he is ok with that he would invite u both to his office and apply for it for you...If he ask you ur passport you can give home the copy u have and all correspondence from HO and say to him u r in the process of renewing it but make sure ur wife to be has any form of id...If u ve a drivers id it might be Very easy for u...i believe he will put all down in writing to apply for ur lineces for you and will take copies of all of them.

You would ve to go and meet the church registrar he is the one who would grant ur common lineces for u....do not go alone.make sure you go with your partner in that way he knows it not sham...all the church want is to join 2 people in holy matrimony not sham weddings.

The church registrar would would give ur vicar the go ahead if he is happy and.believe there aint any dordgy intentions.with the church process is Quite expensive u looking at £1000 for everything. Unlike the register office...

Marrying in the UK without the appropriate visa is also illegal. People from abroad just wanting to marry in the UK and then go home must apply for a special visa. Getting married will not improve your spouses immediate chances of staying here.
