Immigration help for overstayer

Post by toddy » Sun Jul 28, 2013 6:59 pm

Hi

I am an overstayer in the uk. I have just left my job and will be giving up my home as I have no means of supporting myself. I have two british children who are in the uk school system. I am separated from their father. I would like to return home with the children and try to re enter the UK but am not sure if this is the best thing for me to do?
If I stay I have no means of supporting myself and/or them.if I go I am scared I will not be allowed to reenter the uk.

You should consider a human rights application.

Were you subjected to domestic abuse?

Where is the father? Are you seperated or divorce? Is he in the UK?

I dont think it is necessary for you to move overseas.

You will be covered by at least one of the two potential categories you case falls under.

There could be if you are domestically abused, I'm not saying to claim were, however, the definition can be wide and included mental/emotional, physical and financial abuse. You should consider how you've been treated carefully.

There is a reason why you don't see homeless families starving on the streets in the UK. There is a social safety net, even for overstayers. Seek that help. There is no reason for your family to end up homeless in the UK.

It's disconcerting the direction this thread has taken. Don't lie. Don't ever lie. Not only might you destroy the life of your partner for no good reason, if you get caught lying, you can probably forget about ever getting to stay legally in the UK. That said, do consider the situation you are in and how you got there. You've got atleast two very good reasons not to protect anybody.

A few basic questions:
  • * Are you married, or were you ever married, to the father of the children?
    * Is he a citizen, or is he a permanent resident (which is it)?
    * Is he currently in the UK?
    * What are the ages of the children?
    * How long have you been in the UK?
    * On what basis did you originally come to the UK (was it because of your partner)?

I am still married to British husband but separated. Children are 6 and 10. I am seriously considering making an appointment to see home office about flr o and seeing if I can get the visa sorted out as soon as I can but given that I am an overstayer I do not know how this would work?
I came to the uk and was given discretionary leave for 3 years I then got sick and did not renew it and now a year later have been told I am an overstayer so have left my job and given notice on my rented apartment
