When to apply?

Post by T1ilr » Sat Jul 27, 2013 12:19 am

Hello all,

Hope you are all well.

I am sure this question is been asked time and again.

I have asked this question earlier, yet need a final confirmation please.

Hope you'd appreciate my anxiety and help me please.

My initial T1G was approved on 27/12/2008.

I entered UK on 22/01/2009.

Now that I entered within 3 month window, I guess

1) I can apply 28 days before 27/12/2013 for ILR which is 29/11/2013.

2) I can start to look for PEO appointment 42 days prior ie) 18/10/2013. Am I right?

3) assuming that I get PEO appointment for 29/11/2013, can I know when my 15 month window for earnings start? Is it August 2012 to October 2013 or September 2012 to November 2013?

Please can someone have a look at the dates and throw some light as I had some good contracting days last year and a shift in a month would make a significant difference in my earning calculation.

Many many thanks in advance for your help.

You can show ur earnings for any twelve consecutive months from the 15 mths period.

Sorry, I don’t know anything about the 15 month start, but I wanted to point out that sonub4ualt answer to your question 1 may be wrong and you may be risking a failed application if you blindly follow his/her advice.

sonub4ualt: I am quoting UKBA guidelines above as you can see. But what guidelines did you use for your answer to question 1? Please explain it if you are so “sure."

Dear sonub4ualt & dimnus,

I appreciate your endeavour to get across the accurate information.

My question is,

1) when I do my PEO on 29/11/2013, how would I calculate MY 15 month window?

A) because I apply in November 2013, do I calculate in reverse from Oct 13 as 1st month, September 2013 as second month and August 2013 as 3 rd month and so on till August 2012 as the 15 th month, within which I can choose any 12 consecutive months.

OR

B) because I apply on the last working date ie 29/11/2013, can I start counting in reverse, November 2013 as first month, October 2013 as second month, September 2013 as 3rd month and go up until September 2012 as 15th month within which I can choose any 12 consecutive months.

What difference does it make?

In my hay days , in 2012, I was in a fantastic contract and had continuous income. I have stopped taking payments from April this year. Which means any additional month that I get last year in the 15 month window will get me extra income to add and consider and hence more points i will get and hence more peace of mind.

With due respect, please do not send me a link to UKBA document, as I myself have got access to that. The above information that I am explicitly seeking is not available on the policy document.

I am hoping that some of our veteran forum members would guide me through this confusing yet very important turning point in my application form.

Thanks again sonub4ualt and dminus for your contribution.

See it all depends on when your salary gets credited in a month. Simple calculation says September should be fine and I dont see any issues you using that as long as the salary gets credited in your account.

If I would have been in your position I would got for some day in first week of december and count 15 months backwards and pick the 12 consecutive months where I am getting more points.

Hope this helps

Thanks a lot vivdubes.

The key reason why I want to take advantage of last day appointment in November because I would give me an extra month to consider in the beginning of 15 month period which used to be very good financially.

Lets say I apply on 29th November, 2013 and choose my earnings period from August 2012 to July 2013 out of 15 months, then, my earnings total exactly to £40k.

If I apply in the first week of December, 2013, then, I may have to consider my 12 month earnings from September, 2012 to August, 2013 during which my earnings have been £37000.

Obviously I get more points for £40k which is why I'd like to apply asap and use Aug to Jul earnings.

So, in a nutshell, am I good to consider August, 2012 to July 2013 as my 12 month earnings if I apply on 29th November, 2013 ?

Many thanks

Please can you clarify this?

I should apply for ILR in the 1st week of December, 2013 and my 15 month window will be November 2013 to September 2012 (in reverse order).

I am qualifying to apply from 29th November onwards in which case I can consider August 2012 payment as well. Am I right? Can you please tell how date gains important here?

Thanks
