Sponsor of fiance

Post by Jo07871 » Fri May 11, 2007 8:39 pm

Firstly, I would like to thank you for all the information you provide. It has recently helped me to make a successful fiance visa application, despite the fact that my fiance was removed from the UK for overstaying.

My fiance is here on a fiance visa so we can get married in August. As you can guess, I was the sponsor of this visa. His family has recently started to put pressure on him to start working. He understands that this would be against the terms of his visa, but feels a responsibility towards them. I need to know the potential consequences that he could face if he was caught working (I assume this would be removal or deportation) and also the potential consequences for me as his sponsor. Thanks very much.

I'd recommend you steer clear away from that. Why break the law and risk everything? If they find out, he is in big doo doo....I won't scare you, but at the end of the day, if they find out they'd probably be well peeved and decide to ship him back home or refuse his spouse visa. You only have 3-4 months remaining before a spousal visa application, so don't bow to family pressure and break the rules. It is a risk...but the BIA are SMART! Conniving, even. Thinking about breaking the rules (or, even law?) is a big no-no, and could jeopardise his spousal application (now, you won't want to lie, would you?). If you think down the line, you still have to apply for ILR and BC and you don't want to start off with a lie. But, it's good that you have asked before jumping into it with both feet.

Thanks, my fiancee and I both agree and he isn't going to work, but we wanted to know the consequences so we could fully explain the situation to his family and ease some of the pressure!

Any employer employing him while he still has just the fiancé visa would be committing a criminal offence ... is liable to prosecution ... and the fine is unlimited! It used to be a maximum £5000 fine but the law has changed recently.
