ILR for child born in UK, but has travelled outside UK

ILR for child born in UK, but has travelled outside UK

Hello everyone,
My son was born in the UK while we were (and are currently) on Tier 1 General. A few months after his birth he went to India for which I got an Indian passport for him. He returned to the UK on a T1 dependent visa stamped in his Indian passport.

I will soon be eligible to apply for ILR - my question is do I need to include my son on the ILR application, or can I simply register him as British after we get our ILR? I understand that he will have to relinquish his Indian passport if he's registered as British.

As your child was born in the UK s(he) will be entitled to be registered as British by virtue of section 1(3) of the BNA on form MN1 after you are granted ILR. You do not need to include him/her for ILR. You can apply for a British Passport once the registration is complete.

Is there any requirement that child can’t stay out of UK for specific time period before he / she granted BC after parents ILR?

Guys,
I know you might be fed up already because number of time this question has been asked but I just want to clarify something.
According to this post if child has traveled outside UK, he or she still can be registered after parent gets ILR.
I have called HO today and they have said that it is advisable to apply ILR for child as well since her/his visa has an expiry date.
Are they saying this just for fee or there can be any complication?

Will appreciate your help on this.

If the child was born in the UK and one of the parents are now settled (ILR or PR) the child is entitled to register as British no matter where the child is, no visa is needed. The people you ring at the ukba are not caseworkers.
