Please advise -- Moderators/Gurus

Post by sham111 » Thu Jul 25, 2013 4:37 am

I am on ILR and my UK born child is in India at present in India.

He was born before I was granted ILR and I can register him as British citizen using MN1 route.

I know I can apply a British passport for him, but as you know it takes 16 weeks to process from India.

My question as he is due for his Vaccination in the UK.

Is it possible to apply for a Visit visa to the UK and then apply for British passport from here as the time it takes from here is only 2 to 3 weeks.

Please advise what to do in this type of situation.

Many Thanks

Have you registered the child as British yet?

Depending on the status of the other parent you could possibly apply for settlement for the child, but it makes sense to just register the child as British then get certificate of the right of abode or passport otherwise you'll be paying out fees unnecessarily.

My partner is on Tier 1 dependent.

Are you in the UK? If so, you can use the nationality checking service and register the uk born child as British under section 1(3). Once that is done you can apply for the COE for the child in India.

Very sorry to bother you again. Still have 2 questions,

1) Will my child loose Indian Nationality immediately when I register him using MN1, meaning his Indian passport.

2) Can I apply for RoA and keep my Indian Passport , as in few years time I might go back and settled in India for good. So will he loose Indian passport.

Please advise me. For me to decide and take a decision.

Many Thanks

You have to surrender your child Indian passport in 3 months once you get your child registration certificate. Yes kid will loose nationality, but you can apply for OCI card and live in India for good.
