Spouse visa-> dates for replying for ILR

Hi all,

I have a question regarding the correct date possible to apply for ILR in the following situation.

Marriage to British citizen - 6 October 2012.
Applied for visa 22 October 2013, received spouse visa - end of January. Visa expiry date October 2015.

So the person is able to apply 28 days prior to visa expiry date or first entry???

Please advise

28 days before the 2nd anniversary of the first entry date.

If the entry was in February 2013, does it mean another application should be made to extend the visa prior to ILR?

Can you confirm when the spouse applied for the spouse visa? After July 2012, new rule is 5 years for settlement not 2. Under the new rules, you'd need to extend the visa for another 2.5 years. I assume the applicant was outside the uk and was not covered by transitional protection.

The spouse applied in October 2012, outside the UK indeed. So the new rules apply I suppose.

In such case you need to submit flr(m) before the current leave expires, you'll need to meet the financial requirements again.
