Just to flag up if your leave is annulled or curtailed HO will put that in writing advising you so.

@iHope
Welcome to the forum. I am sorry about the refusal. I think you are in a difficult and unfortunate situation. You need to be focused in what you are doing. Right now CONSISTENCY is key in approaching your case. It means that you should avoid going from one application to a different application. HO could see it as a way of circumventing immigration control and use it against you in eventual Court proceedings. You started with FLR(O), then go to the end. I know you are very much tempted to bridge the gap to ten years, but the HO know it. They are expecting you to make a different application for that purpose. You don’t want be where they want you to be. It is true flexibility is on your side but remember that power is in theirs. The game is to get them to surrender their power and the Court is your only option for that. No right of appeal does not mean you cannot go to Court. Talk to your counsel and see your chance of winning then decide. God bless you and your family!
iHope- I noticed that noting was mention about your college closure. You need to check whether you leave to remain has been curtailed. When colleges closed like this, the student are been given 60days to find another college. If you can get another college and entrol then you can cross the 10years long residences. I know it might be difficult kindly look into it because you only need 6months to meet the 10years.
HO must have seen this and they try as much as possible to decide your case and put you in difficult situation.
The route advices by your solicitor flro was right as stated by the HO "that you also wish to rely on family or private life established in the UK pursuant to Article 8 of the ECHR. On 9 July 2012 the Immigration Rules were amended and now include provisions for applicants wishing to remain in the United Kingdom on the basis of their family or private life. These rules are located at Appendix FM and paragraph 276ADE respectively. If you wish the UK Border Agency to consider an application on this basis you must make a separate charged application using the appropriate specified application form (FLR(M) for the 5-year partner, or FLR(O) for either the 10-year partner or 5 or 10 year parent route, or the 10-year private life route). "
The decision was based on you and due consideration were not given to your children, this case is 50: 50 in court. Dependeding on individual circumstance and the Judge. I have read of similar case in which the appeal was allowed and some dismissed.
Please have good discussion with your solicitor and fight the case .
@ iHope
Sorry for refusal.
@kukuwife
What do you think that iHope and his family don’t meet the 276ADE or Suitability criteria. Or the HO just avoids them to circumvent the immigrant by knowing law and makes fad up who are waiting for decision with under age children. On what basis you think the chance is 50:50.Please correct me if i am wrong.

@iHope, you have to serve notice before claim via a letter called Pre Action Protocol letter. HO are supposed to respond to this within 14 days and if they fail to you can apply for permission from the Administrative Court to undertake Judicial Review proceedings.

Believe2013 is absolutely right strongly worded PAP follow by JR.
The caseworker intentionally avoid the best interest of a child. They are creating another backlog of JR and court cases which are very frustrating.

As we havent heard much recently from HO, only few, they may have been on holiday.
I hope and pray that they will come back more reasonable and fresh minded to give everyone on this forum our heart desired wishes within this two months
They will be more miserable to start work after holidays physically present here and mentally still at holiday....
hope not SDP
Haha I hope they get together with some non-EEA hotties... yep!! Then perhaps they ll have a bit more compassion for us lot!
Anyway we often get the news late Friday afternoon! So tomorrow may be a big day for some of us!!
