ILR (minor) dependent application??

Hi all,

Please can you guys help me with a query.

I have booked a PEO appointment at Solihull PEO @ 16/09 and will be applying with 2 dependents (spouse and 3 year old child) - under Tier 1 General visa.

My question is: Is there a need to apply for my 3 year old's ILR? Someone told me I dont need to apply for the child because once I and my spouse get ILR, I can just apply for the chid's british passport (as the child was born in UK). This will save me more than £1000. My current visa expires 05/10.

Are we allowed to this?

If the child was born in the UK then the child is entitled to register as British by virtue of section 1(3) BNA as soon as a parent is grated ILR. The child does not need a visa.

So that means I don't include my child in the ILR application and as soon as the ILR BRP comes through I apply for my child's British Passport? Is this correct?

So I wonder why others include their UK born child in ILR applications as dependents?

You would need to register the child on form mn1 before applying for their passport. Some people may want to travel straight away so they apply for child's ilr or the child may not have been born in the UK.

Sorry guys to bother you again. I was looking at the MN1 application form and under Section 1 PERSONAL INFORMATION -> Point 1.3 -> It asks for the date child was granted ILR.

Does that mean it is now compulsory for the child to have an ILR before s/he applies for naturalisation?

Also looking at this link it looks like the child does need ILR for naturalisation?

1 minor £673, 2 minors £1,178 and for every additional child after £505

For this you will need:

Passport/travel document to cover past 2 years
(if passport or travel document does not cover past 2 years you will require alternative evidence)
Confirmation of indefinite leave to remain for child and parent
Birth certificate
School letter to cover past 2 years for children over 13 years old
Marriage certificate

1. Don't make duplicate posts in different topics.
2. Read 1.3 again "carefully". You will note an "if".
3. To the Luton council, show them the UK birth certificate of the child and tell them that the child has not applied for any passport.
