Please advise me--- few months ago due to contract wasn't signed by both parties.Applied in January and appeal is in Nov. There is almost one year i am keeping money in my account :x Now my appeal is coming so i need advise from all senior members to how to represent the case and anyone whose appeal has been allowed please help me:( :( :( :( :( :( :( :

If that is the only reason your application is refused for then you can claim to have covered under evidential flexibility policy.

You can also say that there were two copies of contract on your table before you apply. You forgot to send one signed.

Provide a signed copy of contract in appeal.

Thanks rizwan appreciated your comment, ive put the same ground that its human error but is it neccessary to show business transactions or can i continue after gtng visa?

The best way of winning any appeal is to get the evidence required by the Home-Office ready before the appeal hearing and present them to the judge explaining fully the reasons why you fail to submit such evidence during your initial application.

In your case if you are allowed to run business with your current visa (which technically is still the visa u have as at the last time of your application) then, you should make sure that you have evidence that your business have been running since your refusal. Also make sure that you have recent fully signed contracts and take along evidence of transactions between yourself and the other party in your contract.

As long as you are able to proof to the judge that you are a genuine entrepreneur, you are very likely to have a successful appeal.

thanks Olasunkanmi, my prob is i dnt hv business acount due to the id unable to open an account, i havent recieved any payment from that client i wanted to start after investing money though currently i am providing services to another company and recieving payment in my personal account, is it necessary to have business with that specific client? kindly advisee

Hi Samz98 and Extension 2013: I have received nearly the same refusal which is 'you have sent a photocopy of contract who's each page must be signed but you have not signed each page'. We are two partners switching from PSW route. We have sent photocopy of contact and kept the original one. We have just appealed against the decision. Any guidance would be highly appreciated.

@ Samz98, u can do business with any client as long as such business is at or above NQF level 4 and also for the purpose of your application, the service should be as stated in your business sector. U can also use your personal account for your business transactions for now since you cant genuinely open a business account, just that you have to keep a full record of all the business transactions for accounting and tax purposes.

Most judges will allow your appeal if you are genuinely doing your business and they can overlook your initial mistake on the basis of ''Evidential flexibility'' as stated by Rizwan567.

Mind you, some judges dislike most silly refusal reason of the HO.
