EEA2 - Non EU marrying EU Citizen

Post by siddiqr » Sun May 20, 2007 12:48 pm

Hi Guys

This is my first time posting a question on this form. I hope i can get some sort of guidance with the problems i am facing.

I am a pakistani national studying in UK since 2002. I graduated in 2004 and doing my research degree since then. My current student visa expires on 31st September 07. I got engaged to a norwegian citizen in Dec 06 and we are getting married in Norway on 28th July. We then plan to come back to UK and live here. She has got one exam left to qualify as Graduate Nurse which she expects to take in October.

We want to know if we can launch an application for residence cards once we come back to UK on 30th July?

Can we apply for our residence cards together?
She has already sent in application for registeration with Nursing council and applying for other jobs as well to show she will be "excercising her treaty rights"???

What else can we do ensure our application is successful. Or i guess the 1st qustion is if we are eligible to apply in circumstances mentioned above.

I'd much appreciate some guidance plaees.

regards,

Riz

I don't think that counts as exercising treaty right, assuming she's not in UK yet which seems apparent from ur post.

She'd only be exercising treaty rights when she's physically present here and then I think she'd have to have been doing that for three months.

Best if she does that, finds a job then can show she can support herself and you assuming you as a student can't support the two of you (you might be rich tho, i dunno!)
