VAF4a form clarification

Hi,

We would be applying for settlement for our new born child, born in India. Both my spouse and myself are settled in the UK with Indefinite Leave to Remain.
We are filling VAF4A form and found that one or more of your documents/guidance is incorrect.

1. The online application form towards the end forces us to select one of the appendix forms to be submitted with the settlement application. And the correct match seems to be the following:

"You should complete Appendix 2 if you wish to come to the UK as:

The spouse or civil partner of someone settled in the UK; or
The child of someone settled‚ or going to settle‚ in the UK; or"


2. But the problem obvious on pulling up Appendix 2 from the link:

Appendix 2 does not mention the category of a child, both of whose parents are settled in the UK. Plus it has also asks people who do not fit the categories mentioned to not fill up that form.

3. Lastly I found that the documentation guidance on the link: http://www.ukba.homeoffice.gov.uk/visas ... /children/

This states: "If you or one of the child's parents is applying to enter, remain, or has limited leave to remain in the UK as a partner or parent, you must meet the financial requirement. In all other cases you will need to show that you have accommodation where you can all live without help from public funds to bring your child to settle in the UK."


I infer from this guidance that there is no need to meet any financial requirements for a child of parents who are settled in the UK and only need to prove availability of accommodation. Following this logic, the online application from is incorrect in asking us to fill in Appendix 2 as quoted section from the form says in Point 1 above as Appendix 2 is a financial requirements related form.

My guess is, assuming both Appendix 2 (Point 2 above) and your online guidance on documentation (Point 3 above) being correct, it is the online application form (Point 1 above) which is incorrect.

Visit visa to UK for new born - Parents have ILR

Hi All,

Is it possible to apply for a visit visa to UK for our new born from India? Both myself and my spouse have ILR. Mom and our baby are in India right now.

The reason we are thinking of applying for a visit visa for our new born is, that the ILR application for our new born from India takes a minimum of 3months which would result in mom being out of UK for more than 90 days.

Pls advice what is the best way to get a visa for our new born.
